What happened

The Landlord applied for termination of tenancy and eviction due to non-payment of rent. During the proceedings, it was discovered the Tenant had passed away. Furthermore, the Landlord's N4 notice was found to be defective because it contained inconsistent rent amounts and the application was filed prematurely on the same day the notice was served. Consequently, the tenancy was terminated by operation of law following the Tenant's death, and the Landlord was awarded arrears from the Tenant's estate.

The ruling

The tenancy is terminated effective July 29, 2025, following the death of the Tenant. The Estate of the Tenant is ordered to pay the Landlord $19,347.71, representing rent arrears and the application filing fee. Interest will accrue at 4% annually if not paid by the due date.
