What happened

The Landlord applied to evict the Tenant for persistent late rent payments. The Tenant admitted to the late payments, but all arrears were cleared by the hearing date. The Tenant's daughter, acting as a support person, assured the Board that future payments would be made on time. Considering the Tenant's age (83) and health issues, the Board granted relief from eviction and issued a conditional order.

The ruling

The Board found the Tenant was persistently late with rent but granted relief from eviction under section 83(2) of the Act. The tenancy continues on the conditions that the Tenant pays rent on or before the first of the month for 12 consecutive months and pays the Landlord's $186.00 application fee. If the Tenant breaches the payment condition, the Landlord can apply to the LTB for an eviction order without notice to the Tenant.
