What happened

The Landlord applied for an ex-parte eviction order after alleging that the Tenants breached a previous LTB order regarding pest control preparation and cleanliness. An ex-parte order was initially issued, but the Tenants filed a motion to set it aside, arguing they had complied and that the small amount of food debris found was only visible after appliances were moved.

The ruling

The LTB granted the Tenants' motion to set aside the eviction order (LTB-L-061808-25). Although the Board found a minor breach of the cleanliness conditions from a previous order (presence of crumbs in the kitchen), the Adjudicator determined it would not be unfair to allow the tenancy to continue. The original conditional order (LTB-L-002655-24) remains in force until September 1, 2026, providing the Tenants a final opportunity to maintain their tenancy.
