What happened

The Landlord applied to terminate the tenancy and evict the Tenants due to significant rent arrears. The Tenants admitted to the arrears but explained they prioritized paying university tuition over their rent obligations. Despite earning over $10,000 in a four-month period, no payments were made to the Landlord. The Tenants requested a conditional order to stay, but the Board found their proposal unsustainable given their current and projected income levels.

The ruling

The tenancy is terminated effective September 30, 2025, unless the Tenants pay $7,686.00 to void the order. If the Tenants do not void the order, they must vacate by the termination date and pay the Landlord $4,492.98 for arrears and filing fees, minus the deposit and interest. Daily compensation of $49.32 applies for each day the Tenants remain past the hearing date.
