What happened

The Landlord applied for eviction because a purchaser requires the rental unit for personal residential occupation. The Tenant contested the application on three grounds: that a partner was also a tenant and was not served notice, that the residential complex contained more than three units (operating as a rooming house), and that the Landlord was in breach of maintenance obligations due to pest infestations.

The ruling

The LTB ordered the termination of the tenancy effective October 27, 2025. The Tenant was ordered to pay the Landlord $541.60, representing the balance of daily compensation for occupation after the N12 termination date, adjusted for the rent deposit and accrued interest. Relief from eviction was denied as the Adjudicator found it would be unfair to the purchaser who had been waiting to close the sale since 2024.
