What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenants due to non-payment of rent in a mobile home park. The Tenants challenged the validity of the N4 Notice, arguing that property taxes for the lot and water/sewage testing fees should not be classified as 'rent' arrears. Additionally, the Tenants argued the notice was not served with the required 14-day notice period.

The ruling

The Landlord's application for termination and eviction was dismissed. The adjudicator found that the N4 Notice of Termination was invalid on two grounds: it improperly included water and sewage testing fees which do not qualify as 'rent', and it did not provide the Tenants with the mandatory 14-day notice period after being served by mail.
