What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. By the time of the hearing, the Tenant had paid all rent arrears up to July 31, 2025. Consequently, the Landlord only sought the recovery of the application filing fee. The Member determined that the Tenant should be granted relief from eviction because the arrears were cleared.

The ruling

The application for eviction was denied as the Tenant paid all outstanding rent arrears before the hearing. The Tenant is ordered to pay the Landlord $186.00 for the cost of filing the application by August 9, 2025. If the payment is not made by the deadline, interest will accrue at an annual rate of 4.00%.
