What happened
The landlord applied for an order to terminate the tenancy and evict the tenant due to the tenant's failure to pay rent as ordered in a previous consent order. The tenant did not pay the full monthly rent on or before August 1, 2021, which was a breach of the consent order.
The ruling
The tenancy is terminated, and the tenant must move out by December 7, 2021. The tenant must pay the landlord $10,227.14, which includes rent arrears up to November 26, 2021 and the costs related to the previous application, less the rent deposit and interest owed on the deposit. The tenant will also owe $59.18 per day for compensation for use of the unit starting November 27, 2021 until the tenant moves out. If the tenant does not pay the full amount by December 7, 2021, the tenant will owe interest at 2% annually on the outstanding balance.
