What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant had not paid the full rent from December 1, 2019 to October 31, 2020.
The ruling
The tenancy is terminated effective November 16, 2020. The Tenant must pay the Landlord $2,606.85 in rent arrears and $175 in application fees, plus $21.37 per day in compensation starting November 6, 2020 until the Tenant vacates the unit. If the Tenant pays $3,325 on or before November 16, 2020, the eviction order will be void and the Tenant can remain in the unit.
