What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to non-payment of rent. Tenants challenged the validity of the N4 Notice due to a rent reduction, but the Board found the notice valid. The Landlord sought eviction within 11 days, but the Board granted relief from eviction subject to a payment plan.

The ruling

The Board ordered a payment plan for the Tenants to pay $15,142.65 in arrears, NSF fees, and costs over 8 months. The Tenants must also pay monthly rent as it becomes due. If the Tenants fail to make any payment, the Landlord may apply for eviction without notice within 30 days of the breach.
