What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were still in possession of the rental unit on the hearing date.

The ruling

The Tribunal ordered that the tenancy be terminated unless the Tenants paid $22,422.27 to void the order by January 27, 2023. If the Tenants did not void the order, they were ordered to pay $13,653.91 to the Landlord and vacate the unit by January 27, 2023. The Tenants were also ordered to pay daily compensation of $68.67 per day starting October 26, 2022 until they vacated the unit.
