Landlord applied for an order to terminate the tenancy and evict Tenants due to substantial interference with the reasonable enjoyment or lawful right, privilege or interest of the Landlord or another tenant. The Landlord served a valid N5 notice on the Tenants.

The ruling

The tenancy is terminated effective September 5, 2021. The Tenants must vacate the unit by that date. The Tenants are ordered to pay the Landlord $14,114.54, which includes compensation for use of the unit from January 11, 2021 to August 25, 2021, less the rent deposit and interest owed on the deposit. The Tenants must also pay $71.80 per day for use of the unit from August 26, 2021 until they vacate, as well as the $186 application fee.
