What happened

The Landlord applied to terminate the tenancy and evict the Tenants due to non-payment of rent. The Tenants vacated the unit on March 15, 2025, prior to the hearing. During the hearing, the Tenants attempted to raise their own issues under Section 82 of the Act, but the Member denied this request because the Tenants failed to provide required disclosure to the Landlord, which would have been procedurally unfair.

The ruling

The tenancy was terminated effective March 15, 2025, the date the Tenants moved out. The Tenants are ordered to pay the Landlord $5,714.08 by July 13, 2025. This amount reflects rent arrears up to the move-out date and the filing fee, minus a $50.00 credit for a deposit. If payment is not made on time, interest will accrue at 5.00% annually.
