What happened

Landlord applied for an order to terminate the tenancy and evict the Tenant due to the Tenant seriously impairing the safety of others in the residential complex. The Landlord submitted evidence that the Tenant's unit was cluttered with combustible materials and obstructed access, violating the Fire Code. The Tenant argued the issues have since been resolved, but the Landlord maintained there were ongoing safety concerns.

The ruling

The Landlord established that the Tenant's actions seriously impaired the safety of others in the residential complex. However, considering the Tenant's age, long tenancy, and the steps taken to resolve the issues, a conditional order is appropriate. The Tenant must maintain the unit free of clutter and combustible items to avoid termination.
