What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to substantial interference with the reasonable enjoyment or lawful right, privilege or interest of the Landlord or another tenant. The application was filed due to repeated incidents of fighting, yelling, screaming, throwing things around, and disturbing the neighbours. The Tenant was also observed with a weapon and there were reports of gunshots and the Tenant being removed by police in handcuffs.

The ruling

The tenancy is terminated effective January 24, 2022. The Tenants must vacate the unit by that date. The Tenants are ordered to pay the Landlord $3,218.56 for use of the unit from September 29, 2021 to January 13, 2022, plus $30.08 per day from January 14, 2022 until they move out, and $186 for the application filing fee. If the Tenants do not pay the full amount by January 24, 2022, they will owe interest at 2% annually on the outstanding balance.
