What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenants due to their failure to meet a condition specified in a previous order issued by the Board on March 23, 2020 with respect to application CEL-91527-19. The condition was that the Tenants did not pay the lawful rent plus $500.00 in arrears to the Landlord in full on or before October 1, 2020.

The ruling

The tenancy between the Landlord and the Tenants is terminated, and the Tenants must move out of the rental unit on or before October 27, 2020. As of the date of this order, the Tenants owe no money to the Landlord because the amount of the rent deposit and interest the Landlord owes on the rent deposit exceeds the arrears of rent that the Landlord is entitled to under this order by $121.14. The Landlord is authorized to offset $45.91 per day for compensation for the use of the unit starting October 17, 2020 to the date the Tenants move out of the unit.
