What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. The Tenant is profoundly deaf and unable to read lips or understand sign language. The Tenant requested an adjournment to prepare evidence and obtain legal representation, as he only received notice of the hearing a few days prior and the envelope did not indicate it was from the Board. The Tenant's father testified that the Tenant was taken to the hospital that morning with heart issues and was unable to attend. The Landlord objected to the adjournment request due to the significant rent arrears.

The ruling

The hearing is adjourned to the soonest available date. The Tenant shall pay the lawful monthly rent of $1,468.45 to the Landlord on or before the 1st of each month until the present application is fully resolved. The Tenant shall provide a detailed list of the section 82 issues and evidence by May 30, 2023. The Landlord shall provide evidence to respond to the Tenant's section 82 issues by June 15, 2023.
