What happened

The Landlord applied to terminate the tenancy and evict the Tenants for non-payment of rent. The Tenants acknowledged the arrears but explained that two cheques were lost in the mail and they were transitioning to direct payments. Significant payments were made by the Tenants between the filing of the application and the hearing date, though a balance remained. The Tenants requested a delay in eviction to resolve the financial issues.

The ruling

The tenancy is terminated unless the Tenants pay $2,147.05 by October 31, 2025, or $5,136.08 by November 30, 2025, to void the order. If the Tenants fail to pay and do not move out by November 30, 2025, the Landlord can enforce the eviction starting December 1, 2025. If the tenancy is terminated, calculations show the Landlord would actually owe the Tenants $3,207.79 (after applying the rent deposit and interest), subject to daily compensation of $98.27 until the move-out date.
