What happened

Landlord applied for an order to terminate the tenancy and evict Tenant because the Landlord intends to demolish the rental unit. The Landlord also claimed compensation for each day the Tenant remained in the unit after the termination date.

The ruling

The tenancy is terminated effective August 15, 2021, and the Tenant must move out by that date. If the unit is not vacated by August 16, 2021, the Landlord may file the order with the Court Enforcement Office for enforcement. The Landlord shall pay the Tenant $2,632.65 in compensation under section 52(1) of the Act, and the pro-rated last month's rent deposit to August 15, 2021 in the amount of $438.78. The Tenant shall pay the Landlord $28.85 per day for compensation for the use of the unit from August 16, 2021 until the Tenant moves out.
