What happened

The Landlord applied for rent arrears and eviction. At the hearing, it was identified that the termination notice was defective because the termination date (March 31, 2025) was prior to the service date (April 10, 2025), violating section 59(1)(b) of the Act. The Landlord elected to proceed with an application for rent arrears only under section 87(1) rather than pursuing eviction.

The ruling

The Tenant is ordered to pay the Landlord $4,686.00 by July 13, 2025. This amount represents $4,500.00 in rent arrears accumulated between February and June 2025, plus the $186.00 application filing fee. No eviction was ordered as the Landlord's notice was defective, and they chose to pursue arrears only.
