What happened
The Landlord applied to terminate the tenancy and evict the Tenant due to substantial rent arrears. The Tenant attempted to raise maintenance or other issues under section 82 of the Act during the hearing but was barred from doing so because no prior disclosure was provided to the Landlord or the Board. Despite multiple offers from the Landlord for a repayment plan, the Tenant, who is currently unemployed, was unable to commit to any payment schedule. The adjudicator found the tenancy no longer viable.
The ruling
The tenancy is terminated effective September 2, 2025. The Tenant is ordered to pay $4,128.11 to the Landlord for rent arrears and the application fee, adjusted for the rent deposit and interest. The Tenant may void the eviction by paying the total arrears and fees by specific deadlines in late August or early September 2025. Daily compensation of $32.71 is ordered until the unit is vacated.
