What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenants for non-payment of rent. Despite receiving a valid N4 notice and several payment plan proposals from the Landlord's representative, the Tenants failed to clear the arrears. The Tenants did not attend the hearing, and while they made significant payments after the application was filed, a balance remained. The adjudicator found no grounds to grant relief from eviction.

The ruling

The tenancy is terminated effective November 1, 2025. The Tenants may void this order by paying $1,905.35 by October 31, 2025, or $3,344.67 by November 1, 2025. If the tenancy is terminated and the Tenants vacate, the Landlord actually owes the Tenants $276.99 (after applying the rent deposit and interest), though this is subject to a daily compensation charge of $47.32 starting October 16, 2025, until they move out.
