What happened

The Landlord applied for termination of tenancy and eviction due to non-payment of rent. The Tenant, a single parent with twin children, acknowledged the arrears but requested relief from eviction. The LTB found that while arrears were significant, an immediate eviction would be unfair to the children who are connected to the local community and school. The adjudicator granted a postponement of the eviction date under section 83 of the Act.

The ruling

The tenancy is terminated effective August 31, 2025. The Tenant can void this order by paying $10,486.00 by July 31, 2025, or $11,886.00 by August 31, 2025. If the Tenant does not void the order and does not move out, they must pay the Landlord $7,741.91 plus daily compensation of $46.03 from July 3, 2025, until they vacate. Eviction is delayed until August 31, 2025, to allow the Tenant time to find housing and minimize impact on her children.
