What happened

The Landlord applied for the termination of tenancy and eviction due to non-payment of rent and NSF cheque charges. The Tenants, who are currently going through separation/divorce proceedings, admitted to the arrears but proposed a repayment plan. Tenant 2 has moved out but remains legally liable under the joint tenancy. The Landlord accepted the financial testimony of the Tenant, and the Board found it appropriate to grant relief from eviction conditional on a strict repayment schedule.

The ruling

The LTB ordered the Tenants to pay a total of $4,082.92. Relief from eviction was granted on the condition that the Tenants follow a monthly repayment plan starting October 2025, paying $355.74 per month in addition to regular rent. If any payment is missed, the Landlord may apply for an ex parte eviction order within 30 days of the breach.
