What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant had not paid the full rent owed from September 1, 2019 to November 30, 2020.

The ruling

The tenancy is terminated effective November 30, 2020. The Tenant must pay the Landlord $460.73 in rent arrears and compensation, plus $4.89 per day starting November 20, 2020 until the Tenant vacates. The Tenant must also pay the Landlord $175 for the application filing costs. If the Tenant pays $689.41 on or before November 30, 2020, the eviction order will be void and the tenancy will continue.
