What happened

The Landlord applied to terminate the tenancy and evict the Tenants due to significant rent arrears. A preliminary issue arose regarding whether Tenant 3 should be removed from the application after serving an N15 notice of termination for domestic violence/abuse. The Board found the N15 invalid due to insufficient notice time. The remaining Tenants admitted they could no longer afford the rent, rendering the tenancy non-viable.

The ruling

The tenancy is terminated effective August 31, 2025, unless the Tenants pay $5,086.00 by July 31, 2025, or $6,846.00 by August 31, 2025, to void the order. If the Tenants do not void the order and move out, they are ordered to pay the Landlord $2,870.54 plus daily compensation of $57.86 from July 24, 2025, until they vacate.
