What happened

The Landlord applied to evict the Tenant for substantial interference. The Tenant was using the building's basement, an area not included in his lease, for excessive personal storage, which blocked access to the building's mechanical equipment and the superintendent's workroom. After being served an N5 notice, the Tenant escalated the situation by installing a padlock on the basement's exterior door, completely barring the Landlord's access. The Tenant was absent from the hearing.

The ruling

The LTB terminated the tenancy effective April 21, 2025, due to the Tenant's substantial interference with the Landlord's lawful rights. The Tenant misused the basement for storage and then padlocked the entrance, barring access. Relief from eviction was denied. The Tenant is ordered to pay the Landlord's $186.00 application fee by the termination date.
