What happened

Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. The Landlord served a valid N4 Notice, but the Tenant did not void the notice by paying the arrears.

The ruling

The Landlord's N4 notice had an incorrect amount of rent arrears, so the Board could not consider termination of the tenancy. However, the Board granted the Landlord's request to proceed with the L1 application for rent arrears only. The Board found the Tenant owed $33,150 in rent arrears to August 31, 2024, plus $186 in application fees, for a total of $33,336 owed to the Landlord.
