What happened

The Tenant requested a review of an order terminating the tenancy and evicting her for non-payment of rent. The Tenant argued that there was new information regarding a payment of $1100.00 and a recently approved rental subsidy. The LTB member conducted a preliminary review without a hearing and found that the $1100.00 payment was already addressed in the original order (noted as uncleared) and that the subsidy approval, which occurred after the hearing, did not constitute valid 'new evidence' for the purpose of a review.

The ruling

The Tenant's request for a review of the eviction order was denied. The Adjudicator confirmed that the information provided by the Tenant did not meet the legal threshold for a review. The original order (LTB-L-080301-25) remains in effect and unchanged.
