What happened

The Landlord applied to terminate the tenancy and evict the Tenant for non-payment of rent. The Tenant raised a Section 82 defense, claiming she was entitled to a $750.00 hydro rebate because the radiators in her unit were not working properly. The Landlord argued that previous rebates had already been paid for past heat issues and that the restoration was complete. The Tenant had unilaterally deducted $750.00 from her rent to account for the perceived rebate.

The ruling

The Tenant's Section 82 claim for a hydro rebate was dismissed. The Tenant was ordered to pay $936.00 (arrears and filing fee). Due to the Tenant's age and long-term residency, and the Landlord's consent, the LTB granted relief from eviction. The Tenant must pay the amount in 12 equal monthly installments of $78.00 starting October 1, 2025, alongside her regular rent. If she misses a payment, the Landlord may apply for an eviction order without further notice.
