What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant had not vacated the rental unit prior to the hearing date.

The ruling

The tenancy is terminated effective February 22, 2022, unless the tenant pays $8,386 to void the eviction order. The tenant must pay $6,764.15 in rent arrears and compensation, less the rent deposit and interest, plus $186 in application costs. The tenant will also owe $29.59 per day in compensation starting February 12, 2022 until they vacate the unit.
