What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants remained in possession of the rental unit at the time of the hearing.

The ruling

The tenancy is terminated effective May 17, 2021. The tenants are ordered to pay $10,992.46 to the landlord, which represents the rent arrears up to May 6, 2021, plus $186 for the application fee. The tenants must also pay $25.48 per day for compensation for use of the unit starting May 7, 2021 until they move out. If the full amount is not paid by May 17, 2021, the tenants will start owing interest at 2% annually on the outstanding balance. If the unit is not vacated by May 17, 2021, the landlord may file the order with the Sheriff for enforcement.
