What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenant due to the Tenant's failure to meet a condition specified in a previous LTB order. The Tenant failed to pay $700 in rent arrears by the due date and also failed to pay the full January 2023 rent on time.

The ruling

The tenancy is terminated effective April 25, 2023. The Tenant must pay the Landlord $9,183.92, which includes rent arrears up to April 14, 2023 and the cost of the previous application, less the rent deposit and interest owed on the deposit. The Tenant must also pay the Landlord $46.43 per day for compensation for use of the unit starting April 15, 2023 until the Tenant moves out.
