What happened

The Landlord applied to terminate the tenancy and evict the Tenant due to non-payment of rent. The Tenant had been served a valid N4 notice but failed to pay the arrears. Despite being served with the notice of hearing, the Tenant checked in 90 minutes late, after the matter had already been heard. Evidence presented showed the Tenant was continuously in arrears for both rent and hydro, leading to the withdrawal of her housing support. The Tenant failed to reach out to housing retention or provide evidence to justify a delay in eviction.

The ruling

The tenancy is terminated effective November 1, 2025, unless the Tenant voids the order by paying $6,245.50. If the Tenant does not pay to void the order, she must vacate by November 1, 2025, and pay the Landlord $3,051.18, representing arrears and filing fees after application of the rent deposit and interest. Daily compensation of $42.12 applies for each day the Tenant remains after October 1, 2025.
