What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The Tenant had passed away on August 4, 2021, and was the sole tenant in possession of the rental unit at the time the application was filed.

The ruling

The tenancy was terminated effective September 3, 2021, 30 days following the passing of the Tenant. The Tenant is ordered to pay the Landlord $3,321.65, which includes rent arrears and the cost of filing the application, less the rent deposit and interest owed on the deposit. If the Tenant does not pay the full amount by October 15, 2021, they will start to owe interest at 2% annually on the outstanding balance.
