What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid N4 Notice, which the Tenant did not void by paying the arrears. The Tenant had vacated the rental unit prior to the hearing date.

The ruling

The Tenant's request for review of the original order was denied. The Tenant consented to the original payment plan order, and the Tenant breached the order by failing to make the required payments. The Landlord's application for termination and eviction was dismissed, and a new payment plan order was issued requiring the Tenant to pay the remaining arrears of $12,726.05 in installments by May 2022, and to pay the full monthly rent by the 1st of each month going forward.
