What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to persistent late payment of rent. The Landlord also claimed compensation for each day the Tenants remained in the unit after the termination date.

The ruling

The Tenants shall pay the full monthly rent to the Landlord on the first day of each month for the period April 1, 2021 to March 1, 2022. If the Tenants fail to make a payment, the Landlord may apply under section 78 of the Act, within 30 days of the breach, without notice to the Tenants, for an order terminating the tenancy and evicting the Tenants. The Tenants shall also pay the Landlord $175.00 for the cost of filing the application. If the Tenants do not pay the Landlord the full amount owing by April 2, 2021, they will start to owe simple interest calculated from April 3, 2021 at 2.00% annually on the balance outstanding.
