What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant had vacated the rental unit on October 30, 2020, prior to the hearing date.

The tenancy was terminated effective October 29, 2020, the date the Tenant vacated the rental unit. The Landlord waived their right to collect any arrears and costs owed by the Tenant up to and including October 30, 2020.
