What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenants due to persistent late payment of rent. The Tenants acknowledged being late with rent payments in the past, but disputed the number of times. The Landlord provided evidence of late payments, including NSF cheques. The Tenant RL argued that the delays may have been due to the Landlord's processing of payments.

The ruling

The Tenants are ordered to pay the Landlord's $186 application fee by August 31, 2021. For the 12-month period from August 1, 2021 to July 1, 2022, the Tenants must pay the lawful rent on or before the first of each month. If the Tenants fail to make any of these payments, the Landlord may apply to the Board for an order terminating the tenancy and evicting the Tenants.
