What happened

The Landlord applied to terminate the tenancy because the Tenant breached a payment condition in a previous LTB order. An ex parte order for eviction was initially issued. The Tenant filed a motion to set aside that order, explaining that while a $300 arrears payment was missed in June 2025, rent was otherwise being paid through disability and housing subsidies. The Tenant requested a more manageable payment plan to avoid homelessness.

The ruling

The Tenant's motion to set aside the eviction order was granted. The previous order from July 18, 2025, is cancelled. A new payment plan was established requiring the Tenant to pay $150.00 per month towards the $2,735.00 arrears starting September 15, 2025, alongside regular rent. Failure to comply allows the Landlord to re-apply for eviction without notice.
