What happened

The Landlord applied to evict the Tenants to perform major renovations, based on an N13 notice. The application was dismissed because the Landlord failed to pay the required one-month's rent compensation by the termination date. The Landlord argued that compensation paid in a previous, dismissed case should suffice, but the adjudicator found this did not meet the statutory obligation for the new notice.

The ruling

The Landlord's L2 application to terminate the tenancy for major renovations is dismissed. The decision was based on the Landlord's failure to pay the mandatory one-month's rent compensation to the Tenants by the termination date specified in the N13 notice. The Board did not accept the Landlord's argument that compensation paid in a previous dismissed case satisfied this requirement.
