What happened

The Landlord applied for eviction under Section 78 after the Tenant breached a previous LTB payment order dated January 3, 2025. An ex-parte order was issued on March 26, 2025. The Tenant filed a motion to set aside this order, citing the death of his father and the departure of a roommate who contributed to rent as reasons for the default.

The ruling

The LTB denied the Tenant's motion to set aside the eviction order. The stay on the previous order is lifted effective July 31, 2025, allowing the Landlord to proceed with eviction. The Tenant is also ordered to pay $25.00 in costs to the Board for behaving aggressively and disrespectfully during the hearing.
