What happened

The Landlord, a corporation, applied to evict the Tenant for personal use by one of its directors and the director's parents. The Tenant challenged the validity of the N12 notice at the hearing, arguing that a corporate landlord is not permitted to terminate a tenancy for personal use under the Residential Tenancies Act.

The ruling

The Landlord's application to terminate the tenancy for personal use is denied. The N12 notice was found to be invalid because the landlord is a corporation, which is prohibited from issuing such a notice under subsection 48(5) of the Residential Tenancies Act. The tenancy shall continue.
