What happened
The Landlord applied for eviction due to non-payment of rent. An initial order was issued in the Tenant's absence. The Tenant requested a review, claiming he missed the hearing because he was excluded from the unit by a restraining order and had a language barrier. While the LTB granted the review and heard the case de novo, it found the Tenant owed over $21,000 in arrears. Despite claiming a high combined household income, the Tenant and the occupant had failed to make any payments for several months.
The ruling
The LTB granted the review of the previous order but still ordered the termination of the tenancy and eviction. The Tenant must pay $15,964.86 to the Landlord if the unit is vacated, or $22,235.34 to void the order and remain in the unit. Relief from eviction was denied because the Tenant failed to make any rent payments for five months despite having a combined household income of $8,000 per month.
