What happened

An Affected Party, who had been renting a room from one of the Tenants and paying rent to them, requested a review of an eviction order. The Landlord had originally obtained an order for non-payment of rent against the named Tenants. The Affected Party claimed they were unaware that the Tenant they paid rent to had no authority to sub-lease and that the Landlord was not receiving the funds. The Landlord argued that no legal relationship existed between them and the Affected Party.

The ruling

The request to review the original eviction order is denied as the Affected Party is not a legal tenant under the Act, having been misled by the original Tenants. The original order terminating the tenancy stands; however, the stay on the eviction is extended until July 31, 2025, to allow the Affected Party time to find new accommodation.
