What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenants due to non-payment of rent. The Landlord served a valid N4 Notice, which the Tenants did not void by paying the arrears. The Tenant testified that he did not receive the N4 notice, but he was aware of the hearing and did not dispute the amount owing.

The ruling

The tenancy is terminated unless the Tenants pay $9,216 by May 31, 2023 or $10,446 by June 16, 2023 to void the order. If the Tenants do not pay, they must vacate the unit by June 16, 2023 and pay the Landlord $7,088.97 plus daily compensation of $40.44 from May 9, 2023 until they move out.
