What happened

The Landlord applied to terminate the tenancy and evict the Tenant due to persistent late payment of rent. The Tenant admitted to paying rent late 20 times over a 30-month period but demonstrated consistent on-time payments for the four months preceding the hearing. The Tenant cited changed circumstances and the presence of children in the home as reasons for relief from eviction.

The ruling

The LTB found that the Tenant persistently paid rent late but granted relief from eviction. The tenancy continues on the condition that the Tenant pays the $186.00 filing fee and November 2025 rent by November 28, 2025, and pays all rent in full and on time from December 1, 2025, to November 1, 2026. If the Tenant fails to meet these conditions, the Landlord may apply for an ex parte eviction order.
