What happened

The Landlord had obtained an ex-parte eviction order after the Tenants breached a mediated settlement from a prior case by failing to make required payments. The Tenants filed a motion to set aside that eviction order. This hearing was held to decide on the Tenants' motion.

The ruling

The Tenants' motion to set aside the eviction order (LTB-L-027554-25) is granted. That order is cancelled. The previous mediated settlement is also cancelled and replaced with a new order. The Tenants must pay rent arrears of $12,833.59 to the Landlord according to a 12-payment schedule starting June 6, 2025. They must also pay their ongoing rent in full and on time. If they fail to make any payment, the Landlord can apply to the LTB for an eviction order without notice.
