What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent and persistent late payment of rent. The Landlord served a valid N8 notice alleging late rent payments over a 6-month period, and the Tenants remained in possession after the termination date. The Tenants did not attend the hearing.

The ruling

The tenancy is terminated effective December 17, 2023. The Tenants must pay the Landlord $18,366.69, which includes rent arrears and the application filing fee, minus the rent deposit and interest. The Tenants must also pay daily compensation of $36 per day starting November 16, 2023 until they vacate the unit. If the Tenants do not pay the full amount by December 17, 2023, the Landlord can file the order with the Sheriff for enforcement starting January 3, 2024.
