What happened
The Landlord applied to evict the Tenant for persistent late payment of rent. The Tenant paid rent late 10 out of 11 times between February and December 2024. After receiving the N8 notice, the Tenant began paying rent on time. The Tenant did not attend the hearing.
The ruling
The Landlord's application for eviction is denied, provided the Tenant complies with a condition. The Tenant must pay rent in full and on time for 12 consecutive months, from July 1, 2025, to June 1, 2026. If the Tenant fails to meet this condition, the Landlord can apply for an eviction order under section 78 without a further hearing. The Tenant is also ordered to pay the Landlord the $186.00 application fee.
